Introduction

In compliance with Regulation (EU) 2016/679 of the European Parliament and of the Council, dated 27 April 2016, this Privacy Policy sets out the terms for the use and protection of the information provided by clients or other interested parties. Our Company is committed to the security of personal data. When we ask for personal information by which you can be identified, we ensure it will only be used in accordance with the terms contained in this document.

Our commitment is to keep your information secure. We use systems and update them to ensure unauthorized access cannot occur.

The purpose of this policy is:

  1. To explain how we use the information you share with us
  2. To ensure you understand what information we collect with your permission and what we do (and do not do) with it;
  3. To assume responsibility for protecting your rights and your privacy according to this policy.

Information Collected and Purpose

The information we collect is necessary for establishing contractual relationships and/or to provide you with information about activities, products, or services related to NEWTON.

We inform you that the personal data you provide as a client or interested party, as well as data you may provide in the future within your relationship with our ENTITY, refer to:

Purpose: Become an Investor.

Access our privacy policy for clients and participants.

Purpose: Contractual relations.

Information on the following types of personal data may be collected:

  • Identification and contact data.
  • Information required for anti-money laundering and terrorist financing prevention, including bank and financial data.
  • Information required by securities market regulation.
  • Information derived from transactions in financial instruments or investment services in which NEWTON has intervened.
  • Identification codes or keys for access and operation within NEWTON’s systems.
  • Data derived from the operations performed.

Purpose: Commercial activity and other communications.

Collected personal data are the identification and contact data necessary to send information. For example, but not limited to: name, surname, postal address, phone number, or email address according to stated reception preferences and available sending options.

Communications about activities, products, or services may be made by any means, including electronic. As an interested party, you must explicitly authorize the sending of commercial communications by ticking the corresponding boxes in any data collection forms, for example, those on our website.

Purpose: Web navigation – Contact.

Contact: respond to information requests received about products and services offered, and answer any other types of queries sent by users.

Data Retention

Your personal data provided will be retained as long as necessary to respond to the contractual relationship, to respond to requests made, and in any case while deletion is not requested by you, as well as the time needed to meet legal obligations according to each data category. As an interested party, you may exercise your rights at any time and make requests about your data.

Based on obligations under the Anti-Money Laundering and Terrorist Financing Law, NEWTON will retain personal data for 10 years from the termination of the business relationship.

Contact: data retention period will last as long as the user does not exercise the right to deletion.

Recipients

Possible recipients to whom NEWTON may deliver personal data are:

  • Public and private organizations and institutions legally obliged to receive them.
  • Third-party service providers with contracts as data processors.
  • Group companies.

Personal data collected will not be transferred to third parties or made public except where you consent, participate voluntarily or due to express legal obligations.

Data Subject Rights

The data subject may exercise their rights on data protection (access, rectification, objection, deletion, automated decisions, limitation of processing, and portability) via email at canal-denuncias@saenzdevalluerca.es. Documentation proving the identity of the applicant (copy of the front of the National Identity Document or equivalent) must be provided.

Maximum response time is 30 days from receipt, extendable up to 2 months if necessary.

In any case, the Spanish Data Protection Agency’s protection can be requested on its website (www.aepd.es).

International Transfer

In some cases, NEWTON may use third-party services outside Spain. If so, NEWTON ensures transfer of data will be to countries with an equivalent level of data protection as the EU, or, if not, will use legal mechanisms to obtain your consent or the authorization from the Spanish Data Protection Agency if transfer occurs outside the EEA.

Minors

Parental or guardian consent is required for minors to receive services offered by the Company.

Security

NEWTON has adopted necessary technical measures to avoid alteration, loss, unauthorized processing or access to your personal data. However, if unauthorized access occurs that may cause serious harm, NEWTON will inform you within a reasonable timeframe so you can take appropriate measures.
